Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of reverecigars.com (the “Site”) and any products or services offered by Revere Cigars LLC (“Revere Cigars,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility — 21+ Only

You must be at least 21 years of age to use the Site or purchase any products. By using the Site, you represent and warrant that you are 21 or older, that you are purchasing solely for personal use, and that you are legally permitted to buy tobacco products under the laws of your state and locality.

2. Age Verification

All orders are subject to age and identity verification through AgeChecker.net. You must provide accurate information for verification. Orders will not ship until verification is successfully completed. Information submitted for verification is governed by our Privacy Policy.

3. Account Registration

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

4. Products, Availability, and Pricing

We try to display our products accurately, but we do not warrant that product descriptions, images, colors, or other content are error-free. Prices and availability are subject to change without notice. We reserve the right to limit quantities, decline or cancel any order, and correct pricing or typographical errors at any time, including after an order has been placed.

5. Orders and Payment

Submitting an order is an offer to buy, subject to our acceptance. We may refuse or cancel any order at our discretion. Payments are processed through WooCommerce and our integrated payment processors (such as Stripe and PayPal). By providing payment information, you represent that you are authorized to use the payment method. All prices are in U.S. dollars unless otherwise stated. You are responsible for any applicable sales, use, excise, or tobacco taxes.

6. Shipping and Delivery

We ship only to U.S. addresses where the sale and shipment of our products is legal. Shipping is handled by third-party carriers [THIRD-PARTY SHIPPERS TO BE CONFIRMED]. An adult 21 or older with valid government-issued ID must be present to receive and sign for delivery. We are not responsible for delays caused by the carrier, weather, customs, or events outside our control. Title and risk of loss pass to you upon delivery to the carrier.

You are responsible for complying with the laws of your state and locality regarding the purchase, shipment, and possession of tobacco products, including any applicable taxes, registration, and reporting requirements. We may decline to ship to jurisdictions where such sales are restricted.

7. Returns and Refunds

Please review our Refund and Returns Policy for details on eligible returns, exchanges, and refunds. Due to the nature of our products, returns may be limited to defective or damaged items. Contact us through our Contact page within the applicable window to initiate a return.

8. Prohibited Uses

You may not use the Site:

  • To purchase products for resale or distribution, or on behalf of a minor.
  • To violate any applicable law, regulation, or these Terms.
  • To provide false, misleading, or fraudulent information, including during age verification.
  • To transmit viruses, malicious code, or any material that interferes with the Site.
  • To attempt to gain unauthorized access to any part of the Site, our systems, or other users’ accounts.
  • To scrape, harvest, or otherwise extract data from the Site without our prior written consent.
  • To use the Site in any way that could damage, disable, overburden, or impair it.

9. Intellectual Property

All content on the Site — including text, graphics, logos, product images, the Revere Cigars name and marks, and all related designs — is the property of Revere Cigars or its licensors and is protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written consent.

10. User Submissions

If you submit any review, comment, suggestion, or other content to us or through the Site, you grant Revere Cigars a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with our business. You represent that you own or control all rights in what you submit and that it does not violate the rights of any third party.

11. Third-Party Links and Services

The Site may contain links to third-party websites or integrate third-party services (such as payment processors, shipping carriers, age verification, and analytics). We are not responsible for the content, policies, or practices of any third-party site or service. Your use of them is at your own risk and subject to their terms.

12. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Health Notice: Tobacco products are intended only for adults and carry health risks. Cigars are not a safe alternative to cigarettes. Use of our products is at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REVERE CIGARS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Revere Cigars and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party rights.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Any legal action arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Alachua County, Florida, and you consent to the personal jurisdiction and venue of those courts.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

17. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
